Litigation

Pleading is the first stage of a lawsuit, and begins with the filing of a complaint by the plaintiff.  The complaint identifies the allegations of facts that give rise to the legal causes of actions, the alleged damaged, and the prayer for relief.

The defendant may respond with a demurrer, which objects to the legal validity of the plaintiff’s complaint, and an answer, which admits or denies the allegations. In addition, the defendant may file a cross-complaint against a co-defendant or a counter-claim against the plaintiff.

Discovery gives each side of a lawsuit the opportunity to obtain evidence from the other parties. Typical discovery devices include depositions, interrogatories, requests for production of documents, and requests for admissions. If opposing parties refuse a discovery request, they can be forced to comply upon filing a motion to compel discovery.
